These govern the representation relationships,17 the transfer of the creditor's rights to another person grounded on the law18 and the termination of an obligation by setoff19 as well as the fraudulent contract negotiations (culpa in contrahendo).20 The third part of the Civil Code ends with the rules determining the law applicable to relations arising from succession.
Law Applicable to Obligations arising from Fraudulent Contract Negotiations
According to the Civil Code127, obligations arising from fraudulent contract negotiations (culpa in contrahendo) are to be governed by the law applicable to the contract, and, in the event that the contract has been left unconcluded, the law that would have been applied, if the contract had been concluded, is to be applied.
